Catskills operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Catskills is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein ("Terms"), describe your rights and responsibilities when you use the Services.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.
Section 1 — Access and account
By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete and that you have all rights necessary to provide it.
You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

We have made every effort to provide an accurate representation of our products and services. However, colors or product appearance may differ from how they appear on your screen due to your device type and settings.
We do not warrant that the appearance or quality of any products purchased will meet your expectations or be identical to how they are depicted. All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, geographic region, or jurisdiction.
Section 3 — Orders
When you place an order, you are making an offer to purchase. Catskills Pets Inc. reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Catskills confirms acceptance. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, change, or cancel an order, we will attempt to notify you using the contact information provided at the time of the order.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
Section 4 — Subscriptions
We offer recurring subscription orders that ship on a schedule of your choosing. By enrolling in a subscription, you authorize us to charge your payment method on a recurring basis at the then-current subscription price until you cancel.
You may pause, modify, or cancel your subscription at any time through your account portal. Cancellations must be submitted at least 2 business days before your next scheduled shipment to take effect for that cycle. Orders already processed and shipped cannot be cancelled or refunded except as provided under our 30-Day Clean Routine Guarantee.
We reserve the right to modify subscription pricing with advance notice. Continued use of a subscription after a price change constitutes acceptance of the new price.
Section 5 — Prices and billing
Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise stated, posted prices do not include taxes, shipping, or handling charges.
You agree to provide current, complete, and accurate purchase and payment information for all purchases. You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are authorized to use such card for the purchase, (iii) charges incurred will be honored by your card company, and (iv) you will pay all charges incurred at the posted prices, including applicable taxes and shipping.
Section 6 — Shipping and delivery
We ship within the United States only. All delivery times are estimates and are not guaranteed. We are not liable for delays caused by shipping carriers, weather events, or circumstances outside our control. Once we transfer products to the carrier, title and risk of loss passes to you. Our Services, including all trademarks, brands, text, images, graphics, video, audio, and the design, selection, and arrangement thereof, are owned by Catskills Pets Inc., its affiliates, or licensors and are protected by U.S. and foreign copyright and intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from the Services without our prior written consent.
Catskills Pets Inc.'s names, logos, product and service names, designs, and slogans are trademarks of Catskills Pets Inc. or its affiliates. You must not use such trademarks without prior written permission. All rights not expressly granted are reserved.

You may be provided with access to third-party tools as part of the Services, which we neither monitor nor control. We provide access to such tools "as is" and "as available" without any warranties or endorsement, and shall have no liability arising from your use of them. Use of any optional third-party tools is entirely at your own risk.

If you leave our Services to access third-party content, you do so at your own risk. Complaints or questions regarding third-party products or services should be directed to the third party.
Section 10 — Relationship with Shopify
Catskills Pets Inc. is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make are made directly with Catskills Pets Inc. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sales between you and Catskills Pets Inc., including any injury, damage, or loss resulting from purchased products. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Catskills Pets Inc.

We reserve the right to suspend or terminate your account at any time if you violate any part of these Terms.

No Agent may access the Services unless it: (i) identifies itself as an Agent in all HTTP/HTTPS requests via the user agent string; (ii) does not conceal or obfuscate that interactions are from an Agent; (iii) responds truthfully when asked whether interactions are from a human or computer; and (iv) does not circumvent any measure intended to block or limit Agent access.
We may limit, by technical or other means, whether and how any Agent accesses the Services. No Agent may access the Services if we have requested that it refrain from doing so.

We may terminate this agreement or your access to the Services at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. EXCEPT AS EXPRESSLY STATED BY CATSKILLS PETS INC., THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
Section 18 — Limitation of liability
TO THE FULLEST EXTENT PROVIDED BY LAW, CATSKILLS PETS INC., ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, AND THOSE OF SHOPIFY AND ITS AFFILIATES, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE.
Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid for the order giving rise to the claim.
Section 19 — Indemnification
You agree to indemnify, defend, and hold harmless Catskills Pets Inc., Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, arising out of: (1) your breach of these Terms; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim. We may control the defense and settlement of such claim at your expense but will not settle any claim requiring non-monetary obligations from you without your consent.
Section 20 — Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed. Such determination shall not affect the validity or enforceability of any other remaining provisions.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms, together with any policies referenced herein, constitute the entire agreement between you and us and govern your use of the Services, superseding any prior agreements, communications, or proposals between you and us.

You may not delegate, transfer, or assign this agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.
Section 23 — Dispute resolution and arbitration

Informal resolution first
Before initiating any formal proceeding, you agree to contact us at support@catskills.co and give us 30 days to resolve the dispute informally. Most issues can be resolved this way.
Binding arbitration
If the dispute is not resolved informally, you and Catskills Pets Inc. agree to resolve it through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in New York, or by telephone or videoconference at your election. The arbitrator's decision will be final and binding.
Class action waiver
You and Catskills Pets Inc. each waive the right to participate in a class action lawsuit or class-wide arbitration. All disputes must be brought in your individual capacity only.
Small claims exception
Either party may bring an individual claim in small claims court in lieu of arbitration, provided the claim qualifies and remains in small claims court.
Section 24 — Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in New York.

We reserve the right to update or modify these Terms at any time by posting changes to this page. We will notify you of any material changes in accordance with applicable law. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
